Terms & Conditions

These Terms and Conditions (“Terms”) govern the purchase and use of home maintenance and exterior home services provided by Silver Pine Home Care (“Silver Pine,” “Company,” “we,” “us,” or “our”).

By purchasing services, signing or electronically accepting a service agreement, enrolling in a service plan, or authorizing Silver Pine to perform services at your property, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agreed to these Terms.

1. Services

Silver Pine provides residential exterior home maintenance services, which may include:

Window cleaning

Gutter cleaning

Exterior siding soft washing

Pest control services

Garbage bin cleaning

Christmas light installation and related services

Other home maintenance services offered by Silver Pine from time to time

The specific services, frequency, pricing, property information, and service plan applicable to a Customer will be identified in the Customer’s service agreement, order, proposal, or account.

Services not specifically included in a Customer’s selected plan are not included unless separately authorized.

2. Service Agreement Term

Silver Pine may offer service agreements with different commitment periods, including 12-month, 24-month, and 36-month plans.

The applicable term begins on the effective date shown in the Customer’s service agreement.

Certain longer-term plans may qualify for reduced startup fees, waived startup fees, discounted monthly pricing, promotional pricing, or other benefits. Any such benefit is conditioned upon the Customer satisfying the requirements of the applicable plan.

3. Startup Fee

Certain Silver Pine service plans include a one-time startup fee.

The amount of the startup fee, including any applicable discounts or waivers, will be disclosed to the Customer before enrollment.

The startup fee may cover costs associated with establishing the Customer’s account, initial service preparation, customer acquisition, scheduling, equipment allocation, administrative expenses, initial property evaluation, and other costs associated with beginning service.

Unless otherwise required by applicable law or expressly stated in the Customer’s agreement, fees already earned for services performed are non-refundable.

4. Billing and Payment Authorization

By enrolling in a recurring Silver Pine service plan, the Customer authorizes Silver Pine and its designated payment processor to charge the payment method provided by the Customer for amounts properly due under the Customer’s service agreement.

Charges may include:

Startup fees

Recurring service charges

Approved additional services

Applicable taxes

Customer-authorized upgrades or add-ons

Other charges expressly disclosed and authorized under the Customer’s agreement

Recurring charges will be processed according to the billing schedule disclosed at enrollment.

The Customer is responsible for maintaining a valid payment method and current billing information.

5. Service Scheduling

Silver Pine will determine service dates based on the Customer’s selected services, service frequency, route availability, weather, staffing, seasonality, property conditions, and other operational considerations.

Service dates and arrival windows may be adjusted when reasonably necessary.

Unless Silver Pine specifically provides a guaranteed appointment time in writing, scheduled dates and arrival windows are estimates and are not guarantees.

6. Weather and Service Delays

Certain services cannot safely or effectively be performed during severe weather, freezing temperatures, high winds, lightning, unsafe conditions, or other circumstances outside Silver Pine’s reasonable control.

Silver Pine may postpone or reschedule a service when conditions make performing the service unsafe, impractical, or likely to produce an unsatisfactory result.

A weather-related rescheduling does not constitute a failure to provide service or automatically entitle the Customer to a refund.

7. Customer Responsibilities

The Customer agrees to provide Silver Pine with reasonable and safe access to all areas necessary to perform the scheduled services.

Customers are responsible for:

Unlocking gates when necessary

Securing pets

Identifying known hazards

Providing accurate property information

Providing access to required service areas

Removing unusually fragile or valuable items from service areas

Informing Silver Pine of pre-existing property damage or conditions that could affect service

Maintaining current contact and payment information

If Silver Pine cannot reasonably perform a scheduled service because access was unavailable or because of a condition within the Customer’s control, the service may be rescheduled and the Customer may remain responsible for charges associated with the scheduled visit to the extent permitted by law and the Customer’s agreement.

8. Existing Property Conditions

Silver Pine is not responsible for damage resulting from pre-existing deterioration, improper installation, defective construction, loose materials, aging surfaces, oxidation, failing seals, damaged screens, cracked glass, deteriorated paint, damaged siding, loose gutters, improperly installed fixtures, water intrusion, structural defects, or other conditions that existed before Silver Pine performed the service.

Silver Pine may refuse to perform work on any area that its personnel reasonably believe cannot be serviced safely or without an unreasonable risk of damage.

9. Service-Specific Conditions

Certain services involve conditions unique to the property.

For window cleaning, Silver Pine is not responsible for pre-existing scratches, failed window seals, hard-water damage, damaged screens, loose frames, or defects that become visible after cleaning.

For gutter cleaning, Silver Pine does not guarantee that existing drainage systems, downspouts, gutters, roofing materials, or underground drainage systems are free from defects or will function properly after debris removal.

For soft washing, results may vary based on surface age, oxidation, staining, organic growth, paint condition, previous treatments, and construction materials.

For pest control, no pest-control service can guarantee the complete or permanent elimination of all pests. Results may depend on environmental conditions, sanitation, neighboring properties, weather, pest activity, and Customer compliance with recommended actions.

For Christmas lighting services, installation and removal schedules may be affected by weather, roof conditions, electrical availability, and safety considerations.

10. Service Satisfaction

Silver Pine wants Customers to be satisfied with completed services.

Customers should notify Silver Pine within a reasonable period after a service if they believe an area included within the scheduled service was missed or improperly serviced.

When appropriate, Silver Pine may inspect the property and, at its discretion and subject to the Customer’s agreement and applicable law, re-perform the affected portion of the service.

11. Cancellation Rights

Customers may have cancellation rights under federal, state, or local law.

Nothing in these Terms is intended to waive, restrict, or eliminate any cancellation right that cannot legally be waived.

Where applicable, Customers will be provided with any legally required notice of cancellation or other disclosures.

If Silver Pine provides a contractual cancellation period that is longer than a cancellation period required by law, the longer contractual period will apply according to the terms provided to the Customer.

12. Five-Day Silver Pine Cancellation Period

Unless a different period is stated in the Customer’s service agreement, Silver Pine allows a Customer to request cancellation within five (5) calendar days after entering into the initial service agreement.

This contractual cancellation period is in addition to, and does not limit, any non-waivable cancellation rights provided by applicable law.

Refund eligibility following cancellation may depend upon whether services have already been requested, authorized, or performed and will be handled in accordance with applicable law and the Customer’s agreement.

13. Early Termination After Cancellation Period

Silver Pine offers discounted pricing and other incentives based in part on the Customer’s commitment to the selected service term.

If a Customer requests termination after the applicable cancellation period but before completing the agreed service term, Silver Pine may charge an early termination amount if, and only to the extent, such amount was disclosed in the Customer’s service agreement and is permitted by applicable law.

Any applicable early termination calculation should be stated in the Customer’s service agreement.

Silver Pine will not impose an early termination charge prohibited by applicable law.

14. Loyalty Plan Benefits

Silver Pine may offer enhanced benefits for Customers selecting longer service commitments.

Benefits may include reduced startup fees, waived startup fees, additional monthly discounts, promotional pricing, or other incentives.

If a Customer terminates a discounted long-term plan before satisfying the agreed commitment, the Customer may lose eligibility for unearned future discounts and may be responsible for an expressly disclosed early termination amount, subject to applicable law.

The specific financial terms applicable to a Customer will be disclosed before the Customer accepts the service agreement.

15. Changes to Services

Customers may request to add, remove, or modify services.

Changes may affect monthly pricing, bundle discounts, service frequency, loyalty discounts, and other plan benefits.

Silver Pine will disclose material pricing changes before implementing an authorized change.

16. Bundle Discounts

Silver Pine may provide discounts when Customers purchase multiple qualifying services.

Bundle discounts apply only while the Customer maintains the services necessary to qualify for the applicable discount.

If a Customer removes a service from a bundle, Silver Pine may recalculate the Customer’s pricing based on the services remaining in the plan.

17. Automatic Renewal

If a Customer’s service agreement provides for automatic renewal, the renewal terms will be disclosed as part of the enrollment process.

Silver Pine will provide notices and cancellation methods required by applicable law.

Where required, Customers may cancel an automatically renewing subscription through the same method used to enroll or through another cancellation method provided by Silver Pine.

Nothing in this section limits any additional rights provided by applicable law.

18. Price Changes

Silver Pine may change pricing for future service periods or renewal periods.

Any price change will be communicated as required by applicable law and will not retroactively change amounts already earned or properly charged.

Pricing during a fixed service term will be governed by the Customer’s applicable service agreement.

19. Failed Payments

If a payment is declined, rejected, reversed, or otherwise unsuccessful, Silver Pine may contact the Customer and request an updated payment method.

Silver Pine may suspend future services while an account remains past due.

Any late fees, returned-payment fees, collection costs, or similar charges will apply only when disclosed, permitted by the Customer’s agreement, and allowed by applicable law.

20. Damage Claims

Customers should report alleged property damage related to a Silver Pine service as soon as reasonably possible after discovering it.

Silver Pine may inspect the alleged damage, request photographs or other documentation, review service records, and investigate the circumstances before determining responsibility.

Customers agree to provide Silver Pine a reasonable opportunity to inspect an alleged service-related issue before arranging repairs for which reimbursement is requested, except where immediate action is reasonably necessary to prevent additional damage or address a safety concern.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Silver Pine will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the provision of services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

22. Safety

Silver Pine reserves the right to refuse, discontinue, or reschedule any service if its personnel reasonably determine that conditions present a safety hazard.

Customers may not require Silver Pine personnel to perform work in a manner that Silver Pine determines is unsafe or inconsistent with its operating procedures.

23. Communications

By providing a telephone number or email address, the Customer authorizes Silver Pine to send communications reasonably related to the Customer’s account, including scheduling notifications, service updates, invoices, payment notices, account information, and customer-service communications, subject to applicable law.

Marketing communications will be handled in accordance with applicable law and any applicable consent requirements.

24. Electronic Records and Signatures

Customers may be permitted to enter into agreements, authorize services, receive disclosures, and sign documents electronically.

To the extent permitted by law, an electronic acceptance or signature will have the same effect as a physical signature.

25. Website Use

Content appearing on the Silver Pine website, including logos, graphics, photographs, service descriptions, written materials, branding, and other content, is owned by or licensed to Silver Pine unless otherwise stated.

Users may not reproduce, distribute, modify, publish, commercially exploit, or misrepresent Silver Pine website content without authorization.

Customers agree not to misuse the website, attempt unauthorized access to Silver Pine systems, introduce malicious software, interfere with website operation, or use the website for unlawful purposes.

26. Third-Party Services

Silver Pine may use third-party providers for functions such as payment processing, customer relationship management, scheduling, communications, accounting, and website services.

Use of certain third-party services may also be subject to the applicable provider’s terms and privacy practices.

27. Privacy

Silver Pine’s collection and use of personal information are governed by its Privacy Policy and applicable law.

Customers should review the Privacy Policy for additional information regarding how personal information is collected, used, stored, and disclosed.

28. Governing Law

These Terms and any applicable service agreement will be governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except where applicable law requires otherwise.

29. Disputes

Customers are encouraged to contact Silver Pine first regarding any service or billing concern so the parties can attempt to resolve the matter directly.

Any formal dispute-resolution requirements, arbitration provisions, venue provisions, jury-trial waivers, or similar terms will apply only if specifically included in an enforceable agreement between Silver Pine and the Customer.

Nothing in these Terms eliminates rights or remedies that cannot legally be waived.

30. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.

31. Entire Agreement and Order of Precedence

These Terms supplement the Customer’s individual service agreement.

If there is a direct conflict between these Terms and a Customer’s signed service agreement regarding pricing, selected services, service frequency, commitment period, or other Customer-specific terms, the signed service agreement will control unless applicable law requires otherwise.

32. Changes to These Terms

Silver Pine may update these Terms periodically.

Updated Terms will be posted on the Silver Pine website with a revised “Last Updated” date.

Changes will apply prospectively except where otherwise permitted by law. Material changes affecting an existing Customer’s contractual rights will be handled in accordance with the Customer’s agreement and applicable law.

BY PURCHASING OR AUTHORIZING SILVER PINE SERVICES, THE CUSTOMER ACKNOWLEDGES THAT THEY HAVE HAD AN OPPORTUNITY TO REVIEW THE APPLICABLE SERVICE AGREEMENT AND THESE TERMS AND CONDITIONS.
